1. About these terms
SPEEDWAVE is a WiFi billing platform that lets internet service providers ("operators") sell hotspot and PPPoE internet to their customers, collect payments through M-Pesa, and manage MikroTik routers.
By creating an operator account, logging in, or buying internet on a SPEEDWAVE-powered hotspot, you agree to these terms. If you do not agree, do not use the service.
2. Operator accounts
- You must give accurate details when signing up, including a working email address and phone number.
- You are responsible for everything done through your account. Keep your password private and tell us straight away if you think someone else has used it.
- You must hold any licences or permissions required to sell internet in your area, including those required by the Communications Authority of Kenya.
- You own your routers, internet connection and other equipment, and you are responsible for setting them up, powering them and keeping them working.
3. Fees
- Platform fees are shown in the Pricing section of this website and may be updated with notice to operators.
- Fees are calculated from your platform earnings and active PPPoE users for each billing period.
- If fees remain unpaid, we may limit or suspend your account until they are settled.
4. Payments from WiFi customers
When a customer buys a package on a hotspot, the sale is between the customer and the operator who runs that hotspot. SPEEDWAVE provides the software that processes the payment and connects the customer, but is not the seller of the internet package.
Payments are handled by third-party providers such as Safaricom M-Pesa and PayHero, and are also subject to their terms. Questions about a purchase, a failed connection or a refund should first go to the operator, whose contact details appear on the hotspot page.
5. Rules for WiFi customers
- A package works on the number of devices it was sold for. Sharing it beyond that limit, including through tethering, mobile hotspots or extra routers, is not allowed and may be blocked automatically.
- Packages run for the time or data shown when you buy them. Unused time or data is not carried over unless the operator says otherwise.
- Keep your M-Pesa transaction code private. It can be used to reconnect your package on your own device.
- Speeds depend on the package, the operator's network and conditions outside our control, and are not guaranteed.
6. Acceptable use
Operators and WiFi customers must not use the service to:
- break any law of Kenya or of the country where the service is used;
- send spam, fraudulent messages or harmful software;
- try to get around payment, device limits or other access controls;
- access another operator's data, routers or customers, or interfere with the platform's security or performance.
7. Privacy and data
- We process personal data such as names, phone numbers, email addresses, payment references and device identifiers in line with the Kenya Data Protection Act, 2019.
- Each operator's data is kept separate and is only visible to that operator and to SPEEDWAVE staff who need it to run and support the service.
- Operators are responsible for the data they collect about their own customers and must use it lawfully.
- We do not sell personal data.
8. Messages
We may send SMS, email or WhatsApp messages needed to run your account or connection, such as verification codes, payment confirmations, expiry reminders and service notices. Operators may also send messages to their own customers through the platform.
9. Availability and changes
We work to keep SPEEDWAVE available at all times, but the service may occasionally be interrupted for maintenance, updates or reasons outside our control, such as power, internet or payment provider outages. We may add, change or remove features over time.
10. Suspension and closing accounts
We may suspend or close an account that breaks these terms, puts other users at risk, or has unpaid fees. Operators may stop using the service at any time by contacting support.
11. Limitation of liability
SPEEDWAVE is provided "as is". To the extent allowed by law, we are not liable for indirect losses, lost earnings or lost data, or for problems caused by operators' equipment, internet providers or payment providers. Our total liability to an operator is limited to the platform fees that operator paid in the three months before the claim.
12. Changes to these terms
We may update these terms. The date at the top of this page shows when they last changed. Continuing to use SPEEDWAVE after a change means you accept the updated terms.
13. Governing law
These terms are governed by the laws of Kenya, and disputes will be handled by the courts of Kenya.
14. Contact us
Questions about these terms can be sent to SPEEDWAVE support on WhatsApp or by Phone.
